These Terms of Service ("Terms") govern your use of the FastCall Flights website (fastcallflights.com) and our toll-free telephone line (collectively, the "Service"), operated by FastCall Flights LLC ("FastCall Flights," "we," "us," or "our"), a Texas limited liability company. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What FastCall Flights does
The Service consists of (a) this informational website and (b) a toll-free telephone line through which a live representative routes incoming calls to one of several independent travel agencies based on the caller's stated trip needs. FastCall Flights is compensated by those agencies for qualified call referrals.
2. What FastCall Flights does not do
FastCall Flights does not:
- Sell, issue, fulfill, or ticket any travel product
- Process or accept payment for any travel product
- Set, control, guarantee, or verify the prices quoted by any partner agency
- Act as agent, employer, partner, or representative of any airline
- Act as agent, employer, partner, or joint venturer of any partner travel agency
All travel bookings, fare quotes, payments, ticket issuance, cancellations, changes, refunds, and post-trip support are handled directly between you and the third-party partner agency. FastCall Flights has no role in those transactions.
3. No travel agency or airline relationship
FastCall Flights is not a registered travel agent, ARC/IATA accredited agency, tour operator, or seller of travel. We are an advertising and lead-referral service. References on our website or in our advertising to "agents," "specialists," or "agencies" refer exclusively to our independent third-party partners — not to FastCall Flights or its employees.
4. Eligibility
You must be at least 18 years old to use the Service. By calling our number or using our website, you represent that you meet this requirement.
5. Acceptable use
You agree to use the Service only for lawful purposes and in good faith. You will not:
- Provide false or misleading information to our representatives or to a partner agency
- Use the Service to harass, threaten, or defraud any person
- Use automated systems to call, scrape, or otherwise interact with the Service
- Attempt to interfere with the operation of the website or phone line
6. Third-party partner agencies
Our partner travel agencies are independent businesses. We do not employ them, control them, or supervise their day-to-day operations. They are responsible for their own pricing, fees, refund policies, customer service, and legal compliance. Any contract you enter into with a partner agency is solely between you and that agency.
We make no representations or warranties about the partner agencies, their pricing, the availability of fares they quote, their service quality, or their financial stability. You should evaluate any agency on its own merits and confirm pricing and policy directly with that agency before authorizing any charge.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FASTCALL FLIGHTS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that any information provided by a partner agency is accurate, complete, or current. We do not warrant any outcome from a call, including (without limitation) the availability of any specific fare, route, schedule, seat, upgrade, or refund.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FASTCALL FLIGHTS, ITS OFFICERS, MEMBERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR TRIP-RELATED LOSSES (SUCH AS MISSED FLIGHTS, MISSED CONNECTIONS, ALTERNATE TRANSPORTATION, OR ACCOMMODATIONS), ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH ANY PARTNER AGENCY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). This limitation applies regardless of the legal theory on which the claim is based.
9. Indemnification
You agree to indemnify, defend, and hold harmless FastCall Flights, its officers, members, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use or misuse of the Service, (b) any transaction or dispute between you and a partner agency, airline, or other third party, or (c) your violation of these Terms or any applicable law.
10. Intellectual property
The FastCall Flights name, logo, and the contents of this website (excluding third-party trademarks) are owned by FastCall Flights LLC and protected by U.S. and international law. You may not copy, reproduce, distribute, or create derivative works from any part of the website without our prior written consent, except for personal, non-commercial viewing. Airline names and logos referenced on this site or by partner agencies are the property of their respective owners.
11. Third-party links
The website may contain links to third-party websites. We do not control and are not responsible for the content, policies, or practices of those sites.
12. Termination
We may, at our sole discretion and without notice, suspend or terminate your access to the Service for any reason, including suspected violation of these Terms.
13. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Service will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
14. Changes to these terms
We may modify these Terms at any time. The revised version will be posted on this page with an updated "Last updated" date. Your continued use of the Service after a change constitutes acceptance of the revised Terms.
15. Severability and entire agreement
If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and FastCall Flights with respect to the Service.
